ORAL ORDER
In this petition, petitioner seeks the following reliefs: i) Issue a writ in the nature of mandamus direct the respondent to fix the monthly pension and commutation of the petitioner from the date of their superannuation and pay the arrears forthwith and also continue to pay the monthly pension regularly as and when it falls due as per representation dated 11.09.2024 and legal Notice dated
03.12.2025 (Annexures – C and E).
ii) Direct the respondents to pay the interest @
18% per annum on the arrears of monthly pension and Pensionary Benefits payable to the petitioner from the date of her retirement till the date of the payment and;
iii) Direct the Respondents to pay Litigation cost of Rs.50,000/- to the petitioner.
iv) Grant such other relief/s as deems fit by this Hon’ble Court considering the facts and circumstances of the case including the costs, in the interest of justice and equity.
2. Heard learned counsel for the petitioner and learned AGA for respondent No.2 and learned counsel for respondent No.1 and perused the material on record.
3. It is the grievance of the petitioner that her representations at Annexures – C and E dated 11.09.2024 and 03.12.2025 submitted to the respondents has not been considered so far by the respondents nor any order has been passed on the same. Under these circumstances, the petitioner is before this Court by way of present petition.
4. Per contra, learned AGA for respondent No.2 and learned counsel for respondent No.1 submit that if reasonable time is given, the respondents would consider and pass necessary order on the said representations.
5. In view of the aforesaid facts and circumstances and rival submissions, the concerned respondent is hereby directed to address the grievances of the petitioner and consider her representations at Annexures – C and E dated 11.09.2024 and 03.12.2025 and pass appropriate order in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
6. Subject to the aforesaid observations and directions, the petition stands disposed of.
