THIS CRL.P FILED U/S 439(1)(b) CR.PC (FILED U/S 483(1)(b) BNSS) BY THE ADVOCATE FOR THE PETITIONER PRAYING TO RELAX/MODIFY THE ORDER DATED:12/12/2025 IN CRL.MISC.NO.469/2025 PASSED BY THE PRINCIPAL DISTRICT AND SESSIONS JUDGE, UDUPI AT UDUPI IN SO FAR AS CONDITION NO.1 THAT PETITIONER SHALL EXECUTE THE BAIL BOND FOR THE VALUE OF RS.5,00,000/- WITH A SOLVENT SURETY AND FURTHER BE PLEASED TO EXTEND THE TIME BY ANOTHER 15 DAYS TO APPEAR BEFORE THE INVESTIGATING OFFICER.

ORAL ORDER

1. This criminal petition is filed by the petitioner seeking modification of the order portion in point No.1 passed in Crl.Misc.469/2025, dated 12.12.2025 on the file of Principal District and Sessions Judge, Udupi. Wherein, the learned Trial Court has imposed a condition to the petitioner that the petitioner shall execute a bail bond for a sum of Rs.5,00,000/- (Rupees Five Lakh) with a solvent surety.

2. Further, the petitioner is also seeking relaxation of the condition to approach the Investigating Officer within a period of twenty (20) days from the date of the order.

3. Learned counsel for the petitioner submits that, insisting the petitioner to furnish a solvent surety and obtaining the said solvent surety certificate during this period before the competent authority is herculean task. Therefore, the petitioner is ready to furnish the surety instead of solvent surety and further, the petitioner prays to extend the time of one (01) month to furnish the surety to approach the Investigating Officer.

4. Considering the submissions made by learned counsel for the petitioner and also the averments made in the affidavit, it is appropriate to allow the petition.

5. Accordingly, I proceed to pass the following:

ORDER

i. This Criminal Petition is allowed

ii. The petitioner shall execute a bail bond for a sum of Rs.2,00,000/- (Rupees Two Lakh) with one (01) surety for the like sum of the satisfaction of the Investigating Officer.

iii. The petitioner shall appear before the Investigating Officer within a period of one (01) month from today to execute the bail bond and also to furnish surety.

iv. The Registry is directed to communicate this order to the concerned Police Station, forthwith.
