(B) Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 2015 — Sections 3(1)(r) and 3(1)(s) — Ingredient of 'public view' — Requirement that the act must take place in any place within public view where members of the public can witness or hear the utterance — Mere presence of accused or parties involved in a private dispute does not satisfy the requirement of 'public view' — Offence not made out if incident occurs within the privacy of a building or a restricted area. (Paras 9.1-9.3)

Facts of the case:
The petitioner, a public servant, faced two separate criminal proceedings arising from property and quarrying license disputes with the complainant. The first case involved alleged assault and verbal abuse under the penal code and the specific Act, while the second case involved allegations of criminal intimidation and hurt. The petitioner sought quashing of these proceedings, arguing they were initiated to harass him due to pre-existing civil litigation.

Findings of Court:
The court observed that the allegations were essentially products of ongoing civil disputes over land and quarrying rights. It found that the ingredients for the offenses under the Atrocities Act, specifically the requirement of insult being made in 'public view,' were absent. Omnibus allegations and the absence of injury certifications further indicated that the proceedings were instituted with ulterior motives to wreak vengeance.

Issues: The main issues were whether the criminal proceedings could be quashed under Section 482 of CrPC despite the filing of a charge sheet, and whether the alleged incidents satisfied the statutory ingredients of the Atrocities Act, particularly the 'public view' criteria.

Ratio Decidendi: Criminal proceedings can be quashed in part or in whole if they constitute an abuse of process or are instituted with mala fide intent. An offence under the Atrocities Act is not established merely by the caste of the victim; there must be an intentional insult in 'public view' to humiliate the member of the vulnerable section. Given the lack of evidence for the alleged offences and the existence of personal, civil disputes, the court found the continuation of proceedings would result in injustice.

Result: Writ Petitions allowed. Criminal proceedings and FIRs quashed.

The parties to the lis are common in both these petitions, but the crime numbers stand different. The petitioner who is common, is accused No.2 in Crime No.109 of 2024 and accused No.1 in Crime No.167 of 2024 concerning Writ Petition Nos.26682 of 2024 and 29801 of 2024 respectively.

2. Heard Sri M. Aruna Shyam, learned senior counsel appearing for the petitioner, Sri B.N.Jagadeesha, learned Additional State Public Prosecutor appearing for respondent No.1 and Sri Clifton Rozario, learned counsel appearing for respondent No.2 in both the petitions.

3. Facts in brief, germane, are as follows: -

W.P.No.26682 of 2024:

3.1. The petitioner is a public servant employed in the Department of Town Planning in the cadre of Joint Director. The mother of the petitioner is said to be holding a quarrying licence for over two decades. On 15-05-2024, the mother of the petitioner was served with an inspection notice from the office of the Mining and Geology, Mandya to be present during the inspection that was scheduled on 25-06-2024. Since the mother of the petitioner was suffering from age related ailments, the petitioner accompanied her to the alleged spot of inspection as well. It is the case of the prosecution that on 25-06-2024, when the petitioner visited the spot, the 2nd respondent and his accomplices questioned the petitioner and accused No.1 regarding digging of trenches in their land.
