When official records contain contradictory dates of service entry, the court will direct the rectification of the record to reflect the factually correct date based on the cumulative evidence available.

ORAL ORDER

In this petition, petitioner seeks the following reliefs;

"(a) Issue a Writ in the nature of Mandamus directing the Respondents to correct the date of joining service of the petitioner as 11.6.2002 and also to consider her for getting the emoluments under the aided institution as is extended to similarly placed persons: and ANNEXURE - A.

b) Pass such others/further orders as this Hon'ble Court deems fit to grant under the circumstances of the case in the interest of justice and equity."

2. Heard learned counsel for the petitioner and learned AGA for the respondent Nos.1, 2, 4 and 5, learned counsel for respondent No.3, learned counsel for respondent N.6 and perused the materials on record.

The limited grievance of the petitioner in the present petition is, despite having recorded that the petitioner joined and entered into service on 11.06.2002, the respondents have given the date of the petitioner joining into service as 20.05.2019 in the Memorandum submitted by the respondent No.4 dated 15.06.2024 and as such, petitioner is before this Court seeking deletion of the said date of joining into service of the petitioner as 20.05.2019. In this context, it is pointed out that the respondents themselves recorded that the petitioner had joined and entered into service on 11.06.2002 at Condition Nos, 5 and 6 and the said error may be rectified.

4. Per contra, learned AGA submits that there is no merit in the petition and the same is liable to be dismissed.

A perusal of the aforesaid documents cumulatively will clearly indicate that the petitioner joined and entered into service on 11.06.2002, but at Annexure - D at serial No.8, the petitioner has been also shown to have joined/entered into service on 20.05.2019, which is factually incorrect and contrary to the material on record.
