THE HIGH COURT OF KARNATAKA
Anant Ramanath Hegde, J
Sudhindra T K – Appellant
Versus
Devaraju – Respondent
MSA No. 121 of 2022

Advocates:
For the Appellants/Petitioners: Sadashivaiah K G
For the Respondents: Subhash Chandra Bose

A court may record a compromise petition filed by parties under Order XXIII, Rule 3 of the Code of Civil Procedure, 1908, to dispose of an appeal, provided the terms are lawful and accepted by the parties involved.

Headnote:(A) Code of Civil Procedure, 1908 - O. 23, R. 3 and S. 151 - Compromise under - Terms of settlement reached between parties during pendency of appeal - Parties agreeing to convey specific property in lieu of partition claim - Court finding no impediment to accept the settlement. (Paras 8-12)

Facts of the case:
The appellants filed a miscellaneous second appeal challenging a judgment and decree passed in a regular appeal, which had remanded a partition suit back to the trial court. During the pendency of the appeal, the parties entered into a settlement agreement. The appellants agreed to convey 19 guntas of converted land in Sy. No. 132 to respondents 1-5, in exchange for the respondents relinquishing their claim over a 1/7th share in the original suit schedule property.

Findings of Court:
The court accepted the compromise petition filed by the parties, noting that it resolved the entire dispute between the relevant stakeholders. The court modified the impugned judgment and decree of the lower appellate court in accordance with the terms of the settlement.

Issues: Whether the court can accept a compromise petition submitted by the parties during the pendency of a second appeal and dispose of the matter according to its terms.

Ratio Decidendi: A court may record a compromise and dispose of a case if it finds no legal impediment, ensuring the settlement aligns with the voluntary agreement of the parties involved in the litigation.

Result: Appeal disposed of in terms of settlement.
