THE HIGH COURT OF KARNATAKA
Anu Sivaraman, Vijaykumar A. Patil, JJ
Karnataka Industrial Areas Development Board – Appellant
Versus
State of Karnataka – Respondent
WRIT APPEAL NO.1382 OF 2023|CIVIL CONTEMPT PETITION NO.169 OF 2024

Advocates:
For the Appellants/Petitioners: K. Shashi Kiran Shetty, P.V. Chandrashekar
For the Respondents: Savithramma, Rohan Veeranna Tigadi

The 2013 Land Acquisition Act is not applicable to acquisition proceedings initiated under the Karnataka Industrial Areas Development Act, 1966, which operates as a self-contained code.

Headnote:The case involves a challenge to acquisition proceedings under the Karnataka Industrial Areas Development Act, 1966. The appellants, being the acquiring authority, contested an order directing compensation based on the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, despite the original acquisition being initiated in 2007. The court examined the applicability of the 2013 Act to KIAD Act acquisitions, confirming the principle that the KIAD Act is a self-contained code. The core issue is whether land acquired under a state-specific act prior to the 2013 Act is subject to the provisions of the latter, specifically regarding compensation recomputation. The ratio decidendi holds that the 2013 Act does not apply to acquisitions initiated under the KIAD Act, as it is a self-contained code and the 2013 Act was not specifically applicable during the relevant period. The final result is that the Writ Appeal is allowed in part; the acquisition is upheld, the entitlement to compensation is confirmed, but the directions to apply the 2013 Act's compensation formula are set aside, with a fresh award directed to be passed within three months.

Table of Content
