THIS WRIT PETITION IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT OF MANDAMUS DIRECTING R-2 TO 9 TO a) PROVIDE IMMEDIATE AND ADEQUATE POLICE PROTECTION TO ALL THE PETITIONERS FACTORY PREMISES DESCRIBED IN ANNX-J AND ETC.

THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER

1. The Petitioner is before this court seeking for the following reliefs:

1. Issue a writ of mandamus directing Respondent Nos. 2 to 9 to:

a) Provide immediate and adequate police protection to all the Petitioner's factory premises described in Annexure-J;

b) Evict all unauthorized persons who have assembled or entered the premises without authority of law and ensure that no such unlawful assembly takes place in future.

c) Direct Respondent No.2 to 9 to ensure free ingress and egress to the petitioner factories as per order dated 22.05.2018 in W.P.No.22645/2018 i.e., as Annexure-P by removing any obstruction there to and also ensure that there is no law and order problem created near the schedule property as indicated at Annexure-J.

2. Pass such other order(s) as this Hon'ble Court may deem fit, in the interests of justice and equity.

2. The grievance of the petitioner is that the members of respondent No.10 are stopping the ingress and egress of the personnel of the petitioner into the factory.

3. The submission of Sri.S.S.Naganand, learned Senior counsel is that whatever the grievance that may be aired by respondent No.10 or its members, the same cannot result in them stopping the ingress and egress of the personnel of the petitioner since the factory is required to be operated and no such obstruction could be afforded by respondent No. 10 or its officers.

Learned counsel for respondent No. 10 submits that Respondent No. 10 and its members are not in any manner stopping the ingress and egress of the personnel of the petitioner or the functioning of the factory of the petitioner. The only issue that they have is as regards the removal of equipment thereof.

5. The above petition being related to stopping the ingress and egress to the petitioner's factories, I am of the considered opinion that even if the respondent No.10 and its members have any claim against the petitioner, those can be agitated in the appropriate forum and is pending finality.

6. In that view of the matter, placing the undertaking of respondent No. 10, counsel for respondent No. 10, that respondent No. 10 and its members would not stop the ingress and digress of the personnel of the petitioner to the factory premises, the petition stands disposed.

7. If there are any other grievance which are available to respondent No.10, it would have to be adjudicated in the appropriate court. The same cannot however give a right to respondent No.10 and or its members to stop the ingress and ingress.

8. It is made clear that this order is categorically limited to ingress and ingress of the persons of the petitioner onto the factories, as per the details furnished at Annexure-J to the petition.

9. It is also made clear that this order shall not come in the way of the petitioner agitating or enforcing any rights that the petitioner may have.

10. The petition is accordingly disposed.
