ORAL JUDGMENT

(PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN)

A joint memo has been filed by appellant No.1 and respondent No.2 in this case.

2. Learned counsel for the parties submit that the matter had already been settled between appellant No.1 and respondent No.1 and had been recorded by partial decree dated 21.11.2025. It is submitted that with regard to respondent No.2 also, a compromise is now entered into between the parties.

3. The terms of settlement entered into between the parties are recorded in the joint memo, which reads as follows:-

"1) Appellant No.1 has agreed to pay a sum of Rs.25,00,000/- towards the share of Respondent No.2 in the Suit Schedule Properties.

2) Respondent No.2 has agreed to receive the sum of Rs.25,00,000/- and give up her share in respect of the Suit Schedule Properties in favour of Appellant No. 1.

3) Appellant No.1 has paid a sum of Rs.12,50,000/- by way of RTGS bearing No.KARBH261572031 on 06.06.2026 and Respondent No.2 acknowledges the receipt of the same.

4) Appellant No.1 has paid the balance sum of Rs.11,50,000/- by way of RTGS bearing UTR No.KARBH26159657899 on 08.06.2026 and Respondent No.2 acknowledges the receipt of the same.

5) Appellant No.1 is paying the balance amount of Rs.1,00,000/- to Respondent No.2 by way of cash before this Hon'ble Court today.

6) Appellants 2 and 3 who are the sisters of Appellant No.1 and Respondent No.1 had filed an affidavit on 17.11.2025 to the effect that they have relinquished their share in favour of Appellant No.1 with respect to the Suit Schedule Properties.

7) Respondent No.2 hereby relinquishes her share in respect of the Suit Schedule Properties and Respondent No.2 and as such, Respondent No.2 and anyone claiming under her have no claim against Appellant No.1 with respect to these properties.

8) Respondent No.2 agrees to withdraw the Final Decree Proceedings initiated by the Respondents in F.D.P.No.22/2022 before the Hon'ble Senior Civil Judge and JMFC, Tarikere.

9) In view of what is stated above, this Hon'ble Court be pleased to accept and record the present joint memo filed by Appellant No.1 and Respondent No.2 in the interest of justice and equity."

4. Parties are also present in the Court today and are duly identified by the learned counsel appearing on their behalf.

5. The terms of settlement are recorded.

6. In terms of the joint memo, the appeal stands disposed of.

7. Registry is directed to draw the decree accordingly.

In view of the disposal of the appeal, pending interlocutory applications do not survive for consideration, and they are, accordingly, dismissed.
