THIS WRIT PETITION IS FILED UNDER ARTICLES 226 OF THE CONSTITUTION OF INDIA, SEEKING CERTAIN RELIEFS.

THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER:

ORAL ORDER

Sri.Manjunatha.B., counsel for the petitioner and Smt.V.Rajini., counsel on behalf of Sri.Pramod.B., for the respondent have appeared in person.

2. The captioned Writ Petition is filed seeking following reliefs:

i. Issue a Writ of Mandamus directing respondent authority to not to take any coercive steps in executing and implementing 7Q order passed by the respondent vide order dated 23.09.2024 bearing No. BG/BNG/RO/MWM/PD/2B/42343/2024-25/455 produced at Annexure-D, till the appeal filed by the petitioner as per Annexure-E in EPF No.97/2024 filed before the EPF Appellate Tribunal is disposed.

ii. Direct the respondent to withdraw the attachment letter dated 18.11.2025 bearing No.BG/BNG M/RO/RECOVERY/42343/2025-26/620 produced at Annexure-G, till the appeal filed before the EPF Appellate Tribunal, Bengaluru as per Annexure-E i.e., EPF Appeal No.97/2024 is disposed.

iii. Pass such other order/s directions as may be deemed fit by this Hon'ble Court, in the interest of justice and equity.

3. Counsel Sri.Manjunatha.B., for the petitioner on instructions submits that the petitioner has filed an appeal before the EPF Appellate Tribunal in EPF/ITB.No.97/2024 and the same is pending consideration and he will purse the appeal before the Tribunal. Counsel therefore, submits that an appropriate order may be passed.

The oral submission made by counsel for the petitioner is placed on record.

4. Taking note of the fact that the petitioner has availed the alternative and efficacious statutory remedy by filing an appeal before the EPF Appellate Tribunal, nothing survives for consideration in the captioned Writ Petition. Hence, the Writ Petition is disposed off.

It is made clear that the interim order granted by this Court on 02.12.2025 shall continue to operate till the disposal of the appeal before the Appellate Tribunal.
