THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:


CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ

ORAL ORDER

1. Petitioner is before this Court seeking for the following reliefs:

“Wherefore, the petitioner humbly prays that this Hon'ble Court may be pleased to :-

i) To issue writ of Certiorari or any other writ or direction and to quash/cancel the registered sale deed dated 19/12/2024 bearing No.DBP-1-12977-2024-25 dated 26/12/2024 stored in central processing unit executed by respondent No.6 in favour of respondent No.7 and registered sale deed dated 19/12/2024 bearing No.DBP-1-12978-2024-25 stored in the central processing unit executed by respondent Nos.9 to 11 in favour of respondent No 7 as per Annexure-J which are registered before the office of the sub-registrar, Doddaballapura. Further issue writ of Mandamus to the respondent No.4 to enter the cancelation of the registered sale deeds in the records of the office of the sub-registrar or in the alternative to issue writ of Mandamus or any other writ or direction by directing the respondent No.1 to 5 to consider the representations dated 02/01/2025 as per Annexure-K to K-8 to the writ petition.

ii) To pass such other order/s as deems fit by this Hon'ble Court in the interest of justice and equity”.

2. The memo has been filed, which reads as under:

“MEMO FOR WITHDRAWAL

The undersigned counsel for the petitioner most respectfully submits that, this Hon'ble Court may be please to permit the Petitioner withdraw the above Writ petition with a liberty to seek alternative remedy. The same may be taken on record to meet the ends of justice and equity”.

3. Learned counsel for the petitioner clarifies that the alternative remedy mentioned in the memo of withdrawal is to pursue the remedy in the suit pending before the Civil Court.

4. Learned counsel for the respondents has no objection for the same.

5. In that view of the matter, reserving liberty to pursue the claim of the petitioner in the pending civil proceedings, petition stands dismissed as withdrawn.
