THE HIGH COURT OF KARNATAKA
M.Nagaprasanna, J
Akarsha – Appellant
Versus
State of Karnataka – Respondent
CRL.P No. 6312 of 2025

Advocates:
For the Appellants/Petitioners: Shivakumar Sanganagouda
For the Respondents: K Nageshwarappa, Chethan U.J

The Court grants permission to withdraw a criminal petition filed under inherent powers when parties have amicably resolved their disputes and the petitioner no longer wishes to proceed.

Headnote:The petitioners invoked the inherent powers of the High Court under the Code of Criminal Procedure (as amended by BNNS) seeking to quash criminal proceedings initiated for offences including cruelty and assault. The core facts involved a family dispute leading to police registration of a case. Upon settlement between the parties, a memo was filed seeking withdrawal of the petition. The primary issue before the court was whether the petitioners could be permitted to withdraw the criminal petition based on an amicable resolution of the underlying matrimonial and family issues. The court followed the standard practice of allowing withdrawal when the parties indicate they no longer wish to press the proceedings. The petition stands disposed of as withdrawn.

THIS CRL.P IS FILED U/S 482 CR.PC (FILED U/S 528 BNNS) TO QUASH THE ENTIRE CRIMINAL PROCEEDINGS AGAINST PETITIONERS /ACCUSED NO.2, 3, AND 4 IN CR.NO.0217/2023 REGISTERED ON 05.10.2023 AND NOW CONVERTED AND REGISTERED AS C.C. NO.674/2024, PENDING ON THE FILE OF CIVIL JUDGE AND JMFC, SAKALESHPURA, HASSAN FOR THE ALLEGED OFFENCE P/U/S 323, 324, 504, 498A AND SEC. 34 OF IPC R/W 3 AND 4 OF DP ACT.

THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA
