THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT OF CERTIORARI OR ANY OTHER APPROPRIATE WRIT, ORDER OR DIRECTION, QUASHING THE IMPUGNED ORDER/NOTIC/RE-AUCTION NOTIFICATION DATED 28.04.2026 BEARING NO. NO.PU.BE./ITARE/53/2025-26, PRODUCED AS ANNEXURE-P AND ETC.

THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER

1. The Petitioner is before this Court seeking for the following reliefs:

a) Issue a writ of certiorari or any other appropriate writ, order or direction, quashing the impugned Order/Notic/Re-Auction Notification dated 28.04.2026 No. bearing No.Pu.Be./Itare/53/2025-26, produced as ANNEXURE-R issued by Respondent No.1;

b) Issue a writ of mandamus or any other appropriate writ, order or direction, directing the Respondents to consider and dispose of the Petitioner's representations dated 26.03.2026 (ANNEXURE-H & J) in accordance with law and within a time frame to be fixed by this Hon'ble Court;

c) Issue a writ of mandamus directing the Respondents to give effect to the General Body Resolution dated 23.03.2026 (ANNEXURE-E) and consequently issue the work order in favour of the Petitioner, being the successful bidder (H1) in the tender process dated 03.03.2026;

d) Grant such other reliefs as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity.

2. The learned counsel for the Petitioner has filed a memo seeking withdrawal of the Writ Petition, which reads as under:-

“The Petitioner respectfully submits that the present Writ Petition has been filed challenging the Re-Tender Notification dated 28.04.2026. During the pendency of the Writ Petition, further proceedings, endorsements and subsequent tender processes have been initiated by the Respondents pursuant to the impugned notification, giving rise to additional grounds and consequential reliefs. In view of the subsequent developments, the Petitioner may be permitted to withdraw the present Writ Petition with liberty to file a fresh Writ Petition challenging the subsequent proceedings and seeking appropriate reliefs in accordance with law., in the interest of justice and equity.”

3. Accepting the said memo, the Writ Petition is dismissed as withdrawn.
