ORAL ORDER

1. In W.P. No.33697/2025, the petitioner is before this Court seeking for the following reliefs:

(a) Issue a Writ of Mandamus or any other appropriate writ, order or direction directing the Central Bureau of Investigation to register an FIR and conduct investigation on the basis of the complaint dated 09.09.2024 Ref.ZO/BLR/LAW/2024-25 viz., ANNEXURE - A;

(b) To grant such other relief or reliefs as this Hon'ble court deems fit to grant in the facts and circumstances of the case in the interest of justice and equity.

2. In W.P. No.33715/2025, the petitioner is before this Court seeking for the following reliefs:

(a) Issue a Writ of Mandamus or any other appropriate writ, order or direction directing the Central Bureau of Investigation to register an FIR and conduct investigation on the basis of the complaint dated 05.09.2024 viz., ANNEXURE - A;

(b) To grant such other relief or reliefs as this Hon'ble court deems fit to grant in the facts and circumstances of the case in the interest of justice and equity.

3. In W.P. No.33733/2025, the petitioner is before this Court seeking for the following reliefs:

(a) Issue a Writ of Mandamus or any other appropriate writ, order or direction directing the Central Bureau of Investigation to register an FIR and conduct investigation on the basis of the complaint dated 08.01.2025 viz., ANNEXURE - A;

(b) To grant such other relief or reliefs as this Hon'ble court deems fit to grant in the facts and circumstances of the case in the interest of justice and equity.

4. The grievance of the petitioner is that the representation submitted by the petitioner on 17.07.2025 at Annexure-E for the grant of special permission for the Central Bureau of Investigation (CBI) to register the complaints of the petitioner and conduct an enquiry/investigation has not been considered and the orders passed.

5. The submission of learned counsel for the petitioner is that there being certain fraud which has occurred as regards various borrowings made from the petitioner- Bank. The funds involved being more than Rs.3,00,00,000/-. It was only for the CBI to investigate the matter. As per the RBI mandate, the same cannot be investigated by the local police. It is for that reason that a request had been made for investigation by CBI, which was refused by CBI on account of the withdrawal of the general consent by the State Government of Karnataka. It is thereafter that the representation dated 17.07.2025 at Annexure-E in all the matters, had been submitted by the petitioner which has not been considered.

6. Taking into account the peculiar facts and circumstances that as per the RBI mandate, it is only the CBI who can investigate the matter, respondents are directed to consider the representation of the petitioner dated 17.07.2025 at Annexure-E and pass necessary orders within a period of eight (8) weeks
