THE HIGH COURT OF KARNATAKA
Suraj Govindaraj, J
Ambati Ramachandra Purushothama – Appellant
Versus
Principal Commissioner of Customs – Respondent
WP No. 27132 of 2025
For the Appellants/Petitioners: Girishkumar R.
For the Respondents: Aravind V. Chavan
A writ petition challenging a show cause notice becomes infructuous once a final order has been passed on that notice, though the petitioner retains the liberty to challenge the resulting final order.
Headnote:The petitioner filed a writ petition under Articles 226 and 227 of the Constitution of India seeking a writ of mandamus to direct the respondents to consider representations and a writ of certiorari to quash a Show Cause Notice dated 11/07/2024 regarding the detention of gold ornaments. The petitioner sought the release of a gold chain and kada weighing 199.85 grams. The primary issue was whether the writ petition challenging the show cause notice remained maintainable after the respondents had already passed a final order on the same notice. The court observed that since an order dated 16.11.2025 had been passed in pursuance of the challenged show cause notice, the challenge to the notice itself had become redundant. Reserving liberty to the petitioner to challenge the order in original dated 16.11.2025, leaving all contentions open, the Writ Petition stands disposed.
