IN THE HIGH COURT OF KARNATAKA AT BENGALURU
Suraj Govindaraj, J
ROHITH TRANSPORTER – Appellant
Versus
HINDUSTAN PETROLEUM CORPORATION LTD – Respondent
WRIT PETITION NO. 32034 OF 2025 (GM-TEN)

Advocates:
For the Appellants/Petitioners: S. Rajashekar
For the Respondents: Pramod B.

A writ petition challenging tender conditions is rendered infructuous if a work order is subsequently issued and that work order is challenged through separate legal proceedings.

Headnote:The petitioners filed a writ petition under Articles 226 and 227 of the Constitution of India seeking to quash Condition No. 14 of the Price Evaluation Criteria and Allocation of Trucks in a tender notification dated 11.09.2025 for the transportation of packed LPG cylinders. The challenge specifically targeted the capping on truck allotment to bidders. The court noted that a work order had already been issued in the matter. The court examined whether the petition remained viable given the subsequent developments. It was observed that since the work order had been issued and was being challenged separately, the current challenge to the tender conditions had been rendered infructuous. Accordingly, the petition is dismissed as infructuous.
