WP No. 31256 of 2025 | WRIT PETITION NO. 31256 OF 2025 (GM-TEN)
For the Appellants/Petitioners: Madhukar M D
For the Respondents: Saritha Kulkarni
A writ petition challenging the legality of a tender process becomes infructuous once the tender has already been allotted.
Headnote:The petitioner approached the court under Articles 226 and 227 of the Constitution of India, challenging the issuance of tender bearing No. SWD/2024-25/IND0305/CALL-4 and specifically seeking to declare Clause 3.18 of the said tender as illegal and void. The court noted the factual development regarding the status of the tender process. The primary issue was whether the tender issuance and its specific clause were void. The court observed that since the tender had already been allotted, the challenge to the process had become infructuous. Placing the said submission on record, the above petition stands disposed
