HIGH COURT OF KERALA
A. Muhamed Mustaque, Shoba Annamma Eapen, JJ
STATE OF KERALA – Appellant
Versus
UNNIKRISHNAN – Respondent
LA.App. 586 2014
SMT.N.SUDHADEVI, GOVERNMENT PLEADER, ADVS.SRI.S.M.PRASANTH FOR R1 SRI.T.H.ARAVIND FOR R1 SRI.V.RAJASEKHARAN NAIR, SC, KERALA ROAD FUND BOARD- R2 & R3.
The court reaffirmed the importance of market conditions and comparable sales in determining land acquisition compensation, leading to significant enhancement from previous awards.
Headnote:
Compensation - Land Acquisition - Kerala Land Acquisition Act, 1961 - Sections 23(1A), 54 - The court assessed the valuation of acquired lands for compensation purposes, interpreting the classification of land and the adequacy of evidence for valuation, concluding that enhanced compensation was justified.
Fact of the Case:
Land Acquisition Appeals were filed regarding compensation for land acquired for road widening under the Kerala Land Acquisition Act, with disputes over the adequacy of compensation awarded by the Reference Court. Both the State and the claimants sought appeals against the award.
Finding of the Court:
The court found that the Reference Court's classification of acquired lands as garden land was justified and that the compensation awarded by the Reference Court was inadequate, leading to an enhancement in compensation from approximately Rs.3,00,000/- to Rs.4,50,000/- per cent.
Issues: The key issues were whether the land classification as garden land was appropriate and whether the compensation determined by the Reference Court was adequate considering the current market conditions.
Ratio Decidendi: The court concluded that the surrounding area's commercial potential justified the enhancement of compensation. It emphasized the necessity of comparing the acquired properties with relevant sale transactions post-notification, dismissing outdated assessments.
Final Decision: Compensation increased to Rs.4,50,000/- per cent with additional statutory benefits.
