J U D G M E N T

MACA No.2219 of 2010 is an appeal filed by K.Elizabath and others, who are the original petitioners in O.P.(MV)No.646 of 2001, pending before the Motor Accidents Claims Tribunal, Punalur. In this matter, dismissal of the claim petition filed by the appellants before the Motor Accidents Claims Tribunal, Punalur is under challenge.

2. Going by the order impugned, O.P.(MV) No.646 of

2001 was dismissed highlighting pendency of O.P.(MV)No.552 of 2002 before the Motor Accidents Claims Tribunal, Alappuzha filed by Sofia and another, in relation to the same accident.

3. O.P.(MACT)No.1023 of 2010 is an application filed by Sofia and another challenging impleadment of K.Elizabath and others in O.P.(MV)No.552 of 2002.

4. When this matter was taken for hearing last time, the learned counsel for the petitioners in O.P.(MACT)No.1023 of 2010 submitted that the matter has been settled between the parties and nothing survives to be adjudicated.

5. In view of the submission, I have directed both parties to produce the settlement and also called for a report from Motor Accidents Claims Tribunal, Alappuzha regarding the present stage of O.P.(MV)No.552 of 2002. It is reported by the learned T
