JUDGMENT
Dated this the 2 4 t h day of July 2020 This writ petition is filed seeking the following reliefs :-
(i) “Issue a writ in the nature of mandamus commanding the second respondent to execute the agreement with the petitioner in pursuance of exhibit-P1 without insisting on treasury saving deposit towards the performance guarantee and security deposit.
(ii) Issue a writ in the nature of mandamus commanding the second respondent to adjust the money towards the performance guarantee and security deposit from the unpaid bills of the petitioner.”
2. Heard the learned counsel for the petitioner and the learned Government Pleader.
3. It is submitted by the learned counsel for the petitioner that the petitioner has been awarded with a work as evidenced by Ext.P1 and that he has been required to submit performance guarantee in terms of the selection notice issued. It is submitted that the petitioner is liable to be paid bill amounts which have been sanctioned and certified as evidenced by Ext.P2. The learned counsel for the petitioner submits that the sanctioned bill amounts are liable to be adjusted towards the performance guarantee and security deposit as required in terms of Ext.P1.
