JUDGMENT

The petitioner is before this Court seeking to quash Ext.P6 order issued by the Joint Registrar by which the period of inquiry under Section 65 of the Kerala Co-operative Societies Act, 1969 (for short, the ‘Act, 1969’) has been extended by a further period of three months.

2. Sri. Swathi Kumar, B.S., the learned counsel appearing for the petitioner, submitted that originally Ext.P2 order was issued under Section 65 of the Act, 1969. Later Ext. P3 order was issued by the 1st respondent, wherein it has been stated that Ext.P2 order has been withdrawn as certain material defects had crept in. Later, Ext.P5 order was issued, extending the period of inquiry by a further period of three months. According to the learned counsel, as per Rule 66(3) of the Kerala Co-operative Societies Rules, 1969, if the inquiry or inspection cannot be completed within the time stipulated in the order, the person conducting the inquiry or inspection is required to submit an interim report stating reasons for non-completion of the inquiry.
