These two appeals arises of the common award in OP(MV)Nos.1907 and 2116 of 2016, dated 31.10.2019 on the files of the Motor Accidents Claims Tribunal, Ernakulam and hence are being considered and disposed of together.
2. The facts for disposal of the case are as follows: On 31.05.2014 at 8.30 a.m., while the vehicle was ridden by Sri.Ajay Jacob with Sri.K.M.Yacob as a pillion rider travelling to Vandipetta- Vennikulam road from west to east and when they reached near Kumbappilly Chapel, a Tata Sumo driven by the 1st respondent in the claim petitions bearing Registration No.KL-39/D-6696 came in a rash and negligent manner and hit against the vehicle, thus causing serious injuries to both the rider as well as the pillion rider. Both the persons approached the tribunal with the claimant issue. The claimant Sri.K.M.Yacob claimed that he was working as a driver in Kuwait and was earning an income of Rs.50,000/-.
