BY ADV P.C.SASIDHARAN THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 29.07.2022, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
J U D G M E N T
The petitioners singularly pray that Calicut University be directed to conduct examinations for the 5th & 6th Semesters of 2019-22 three year LL.B. course within a time frame to be fixed by this Court and further that the results of the other Semesters of the said Course, be directed to be declared without any further delay.
2. However, when this matter was called today, Sri.C.M.Nazar –
learned counsel for the petitioners, conceded that the 5th Semester examinations have now commenced pending this lis, and is scheduled to be over on 03.08.2022. He submitted that, therefore, the University may be directed to conduct the 6th Semester examinations without any further delay.
3. Smt.Akhila Shoji – learned counsel representing Sri.P.C.Sasidharan, learned Standing Counsel for the University, submitted that a detailed affidavit has been filed on record, explaining why and how there was a delay in the conduct and completion of the examinations. She submitted that, on account of various factors, including the COVID-19 pandemic disruption, the original academic calendar could not be followed, but that steps are now being taken by the University to ensure that the course is completed and the examinations conducted without any further avoidable delay.
4. When I consider the afore submissions, it is indubitable that all which this Court now requires to order is for conduct of the 6th Semester examinations and publication of the results of the other Semesters in a time bound fashion.
Resultantly, I order this writ petition, directing the University to conduct and complete the 6th Semester examinations not later than 30.09.2022. I fix this time, taking note of the submissions of the University that the 6th Semester examinations can be conducted only after the 5th Semester examinations are over and after giving the students sufficient time for preparation.
Needless to say, as regards the examination results are concerned, it shall be declared by the University without any avoidable delay, but within the time frames as are statutorily mandated.
I also leave liberty to the petitioners to approach this Court for any further clarification if it becomes so warranted in future.
