CENTRAL BOARD OF SECONDARY EDUCATION, (CORRECTED) – Respondent


JUDGMENT

The petitioner says that she completed her Senior Secondary School studies from the 'Vyasa Vidya Peethom', Palakkad and that she obtained Ext.P8 Mark Statement, wherein, her date of birth has been shown incorrectly as 05.03.1990. She says that, as is evident from Ext.P1 Certificate of Birth issued by the competent Local Self Government Institution, her real date of birth is 05.06.1990 and that when she applied for correction of the entires in Ext.P8 consequent thereto, it was rejected through Ext.P5, merely saying that her application is time barred.

2. The petitioner contends that the stand of the

1st respondent - Central Board of Secondary Education (CBSE) is egregiously improper, particularly in view of the declarations made by the Hon'ble Supreme Court in Jigya Yadav v. C.B.S.E [2021 (3) KLT 711].

3. The petitioner thus prays that Ext.P5 be set aside and the competent Authority of the CBSE be directed to reconsider her application, thus leading to the correction of the entries in Ext.P8, to show her date of birth as being 05.06.1990, instead of

05.03.1990 as is presently recorded.
