ORDER

Petitioner challenges the final report in C.C. No.824/2024 on the files of Judicial First Class Magistrate Court-III Muvattupuzha. The aforesaid proceedings arise out of Crime No.1089/2023 of Muvattupuzha Police Station alleging that petitioner had committed offences under Sections 153 and 506(i) of the Indian Penal Code, 1860.

2. The prosecution alleges that the petitioner, who is a member of a WhatsApp group, had, with intent to commit rioting amongst the public, posted a message stating that a plan had been formed to kill the Chief Minister and the Cabinet Ministers of Kerala before 08-07-2024 and posted a letter in the WhatsApp group on 28.06.2023 purportedly addressed to the Director General of Police and thereby committed the offences under Sections 153 and 506(i) of IPC.

3. I have heard Smt.Radhika Ramachandran, the learned counsel for the petitioner as well as Smt. Sreeja V., the learned Public Prosecutor.

4. A perusal of the final report reveals that the accused is alleged to have posted in the WhatsApp group, a letter addressed to the Director General of Police which reads as follows: ‘This is to let you know that we have mobilised our troops. Our next target is the Ch
