ORDER
Dated this the 2nd day of February 2021 Application for regular bail.
The petitioner is the accused in Crime No.1274/2020 of Mala Police Station, Thrissur District registered for the offences punishable under Sections 341 , 451, 354, 354(A)1(ii) of the Indian Penal Code and Section 92 (b) of Rights of Persons with Disabilities Act, 2016 .
2. The petitioner has been in custody since 05.12.2020.
3. The prosecution allegation is that on 03.12.2020 at about 21.30 hours this petitioner has trespassed into the residential house of the defacto complainant and with the intention to outrage the modesty of the daughter-in-law of the defacto complainant, who is a mentally retarded person, hugged her and touched on her breast and there by committed the aforesaid offences.
4. It is submitted by the learned counsel for the petitioner that the allegations levelled against him are absolutely false and baseless. In fact, he had some money transaction with the defacto complainant. On 03.12.2020 he went to his residence and demanded the money but he refused to return the same and then he told that he would initiate legal proceedings against him.
