JUDGMENT

Petitioner is a proprietary concern dealing with re-refined used oil, automotive and industrial lubricants, recycled fuel oil, etc. is the submission. The petitioner was allotted 98.8 cents of land in Survey Nos.62/3, 62/1 Pt, 62/3 Pt, in the industrial development area of Kadungalloor village in the development area of Edayar on hire purchase basis for starting a unit for the manufacturing of re-refined used oil, re-refined lube oil, automotive and industrial lubricants etc. It is submitted that the above mentioned 98.8 cents of land was allotted on various occasions as small plots. The petitioner had remitted the full cost of the land and applied for assignment of the land is the submission. Out of the

98.8 cents of land, 50.69 cents was assigned in favour of the petitioner as per Ext.P1. On the basis of Ext.P1 order, patta was issued in favour of the petitioner on 18.7.2001 for the 50.69 cents of land, as evident by Ext.P2. It is also submitted that the petitioner was also given a No Objection Certificate as per Ext.P1 for mortgaging 50.69 cents of land with its Bank, namely the Union Bank of India, Binanipuram Branch, for availing a loan.
