JUDGMENT
The petitioner herein is working as a Lower Division Clerk in the Academic section of the 3rd respondent, the SI-MET College of Nursing. He is an insured person with ESI No.4707936183 and is eligible for benefits under the ESI Scheme including medical benefits to himself and his family by virtue of his employment with the 3rd respondent. His mother underwent treatment in various hospitals and incurred expenses of Rs.1,38,916/- and she later left for her heavenly abode on 08.03.2019. For getting benefits under the ESI Act, he approached the Corporation. It was then that he realized that the 3rd respondent had not registered his name with the ESI Corporation. Several litigation ensued before various forums. Later his name was registered and the 3rd respondent has remitted a sum of Rs.1,11,894/- in the name of ESI Fund Account No.1 by Exhibit-P9 order. His grievance is that though the petitioner is entitled to a total sum of Rs.1,38,916/-, the respondent Corporation has refused to disburse the amount due to him on the ground that the original bills were not handed over.
