The application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 , by the second accused in Crime No.18/2024 of the Hosdurg Excise Range Office, Kasaragod, which is registered against the accused persons for allegedly committing the offences punishable under Sections 20 (b)(ii)(B), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, ‘the Act’). The petitioner was remanded to judicial custody on 19.08.2024.
2. The gist of the prosecution case is that: on 19.08.2024, at 22:35 hours, the accused was found in conscious possession of 6 Kilograms of ganja. He was arrested on the spot with the contraband article. Thus, the accused have committed the above offences.
3. Heard; Sri. T. Madhu, the learned counsel appearing for the petitioner and Sri.Ajith Viswanathan, the learned Public Prosecutor.
4. The learned counsel for the petitioner submitted that the petitioner is totally innocent of the accusations leveled against him. There is no material to substantiate the petitioner’s involvement in the crime. Indisputably, the contraband involved in the case is of an intermediate quantity
