This petition has been filed under Section 482 of Code of Criminal Procedure , 1973 to quash Annexure-16, order of taking cognizance in C.M.P.No.280/2023 dated 01.06.2023 and Annexure-1 compliant in CC No.823/2023 on the files of Judicial First Class Magistrate Court-I, Kasaragod.
2. First petitioner is the petitioner in OP No.812/2022 filed before Family Court, Kannur, and the 2nd petitioner is the father of the 1st petitioner.
3. Heard the learned counsel for the petitioners and the learned counsel appearing for the 1st respondent and the learned Public Prosecutor appearing for the 2nd respondent.
4. Tracing the genesis of the prosecution case, Annexure-A1 complaint was filed by the 1st respondent herein / 2nd respondent in the divorce OP, alleging that the petitioners herein committed offences punishable under Sections 500 , 501, 502 of the Indian Penal Code , 1860 (for short 'the IPC ').
