JUDGMENT
Petitioner is a 2nd Semester Engineering B.Tech Artificial Intelligence and Machine Learning student at the Sreenivas University Institute of Engineering and Technology, Mangalore. By reason of his father's financial constraints, the petitioner is forced to avail an educational loan for continuing his course. To this end, the petitioner submitted Ext.P4 loan application on 06.04.2024 and was issued with Ext.P5, informing that he was not eligible for the loan in view of the delinquency noted in his father's CIBIL report. Aggrieved, this writ petition is filed seeking a direction to the respondents to process and disburse the educational loan of Rs.6.12 lakhs applied by the petitioner.
2. Heard, Adv.Shiyas K.R. for the petitioner and Senior Advocate Chandran Pillai, instructed by Adv.S.Ambily, for the respondents.
3.Learned Counsel for the petitioner relied on the decision of this Court in Pranav S.R. v. Branch Manager, State Bank of India and Anr. [AIR 2020 Ker 161], to contend that an educational loan cannot be denied based on the credit score of the co-obligant.
