JUDGEMENT

The issue involved is regarding the right of the petitioner to participate in the election process of the Kollam Bar Association.

The respondent Bar Association appeared through counsel and submitted that even though the petitioner was a member and had paid the subscriptions, by a mistake her name was not added in the electoral roll. It is submitted that there are other persons also whose names had been missed out in the same fashion and all the said persons have submitted representations before the Association. Since it is a case where the mistake had happened on the part of the Association and not on the part of the petitioner and similarly situated persons, it is only appropriate that the 2nd respondent is directed to include such persons also in the voters list and permit them to participate in the electoral process.

The writ petition is disposed of directing the 2nd respondent to include the petitioner and persons similarly placed, who had submitted objection regarding their non inclusion despite being members,
