JUDGEMENT

Dated this the 25th day of April, 2024 This is an application seeking parole for the petitioner who has been convicted and sentenced to rigorous imprisonment for four years and to a fine of Rs.75,000/- (Seventy Five Thousand) and in default of payment of fine to undergo imprisonment for six months for the offence punishment under Section 20 (b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act,

1985. The conviction and sentence has been confirmed by this Court by judgment dated 10.07.2020 in Criminal Appeal No.992/2013. The present petition seeking parole is on the ground that as he is suffering from cancer and that he needs to take treatment from MVR Cancer Centre and Research Institute, Kozhikkode.

2. Report of the Superintendent Central Prison & Correctional Home, Thiruvananthapuram has been called for. The relevant portion of the report reads thus;

    “On 14/03/24 he has consulted at Nephrology and Urology OPD at Govt. MCH TVM advised for an USG Abdomen evaluation. The study was conducted on 25/03/24, with the report on the same day urology advised to review after 1month. His nephrology review advised to restrict the intake of water and to avoid nephrotoxic medic
