ORDER
The application is filed under Section 438 of the Code of Criminal Procedure, 1973 , for an order of prearrest bail.
2. The petitioner is the sole accused in Crime No.922 of 2024 of the Ottapalam Police Station, Palakkad, which is registered against him for allegedly committing the offences punishable under Section 420 of the Indian Penal Code.
3. The prosecution case come up in brief, is that: the accused is conducting a travel agency named 'Best Air International Tours & Travels' at Vaniyamkulam. The first informant had approached him to secure an employment Visa in Sharjah, UAE, which the accused agreed. Consequently the first informant paid Rs.1,30,000/-. However, the accused did not secure the employment and refused to return the money.
Thus, the accused has committed the above offences.
4. Heard; Sri.Nireesh Mahew, the learned counsel appearing for the petitioner, Smt.Seetha S., the learned Senior Public Prosecutor and Sri. R.K.Prasanth, the learned counsel appearing for the second respondent.
5. The learned counsel for the petitioner submitted that the petitioner is totally innocent of the accusations levelled against him. The materials placed on record substantiate that
