JUDGMENT
The moral and social values among the families in India over a period of time has been deteriorated in as much as that the married children even have scant regard and respect for the senior citizen, impelling them to approach the competent authority established under the Maintenance and Welfare of Parents and Senior Citizens Act , 2007 (hereinafter referred to as ‘the Act’, for short).
2. Present case is of such kind where Jameela 71 years of age, widow of Late Moideen preferred MCC.No.202/2017 before the Maintenance Tribunal seeking eviction of the petitioner Smt.P.P.Sajitha for vacating the residence which she was occupying along with her family and four children. Case of Jameela was that all her children along with herself and family were residing in Tharawad house for the last ten years. She was being harassed by the petitioner both physically and mentally by scolding, torturing and beating only for pressurizing to construct a house of her own. Jameela, 1st respondent, released 1.8 ares of land to the petitioner as per the Release Deed No.4476/2011 dated 29.12.2011.
