HIGH COURT OF KERALA

STATE OF KERALA – Appellant
Versus
P.K.RAJESWARI – Respondent
LA.App. 812 2014

Advocates:
SMT.N.SUDHADEVI, GOVERNMENT PLEADER

SRI.V.RAJASEKHARAN NAIR, SC FOR KERALA ROAD FUND BOARD FOR R2 & R3

Property classifications and compensation valuations under the Land Acquisition Act may deviate from official records when justified by current market conditions and property importance.

Headnote:

Land Acquisition - Kerala Land Acquisition Act - Sections 23(1A), 54 - The court upheld enhanced compensation determinations by the Reference Court by classifying various properties consistently and established that 12% additional land value is applicable from the notification date until possession.

Fact of the Case:

Various appeals were filed related to land acquisition for road widening, challenging previous compensation amounts awarded to both the State and claimants. The Reference Court had adjusted the land values significantly based on local property importance and market trends.

Finding of the Court:

The court determined that the Reference Court's classification and valuation methods were legitimate, adhering to the law, and that the claimants warranted the enhanced compensation due to the land's strategic importance.

Issues: Whether the Reference Court appropriately classified the properties and correctly established compensation values for the land acquired.

Ratio Decidendi: The court confirmed that land classifications can differ from official records based on current uses and market conditions, thus validating compensation adjustments.

Final Decision: The compensation amount was enhanced to Rs.4,50,000/- per cent with statutory benefits.
