Dated this the 19th day of December, 2022 The petitioner is the 2nd accused in crime No.121/2013 of Mankada Police Station, which was registered for the offences punishable under Sections 143 , 147, 148, 341, 324, 326, 506(i)

read with Section 149 of the Indian Penal Code .

2. The prosecution case is that, on 31.03.2013 at 5.30 p.m., CWs 1 to 4 were manhandled by the petitioner and five other persons, and thereby committed the offences. Annexure-A1 is the final report submitted by the Police. Earlier, the trial of the said case was conducted before the Judicial First Class Magistrate's Court-II, Perinthalmanna as C.C. No.799/2013 in which all the accused persons except the 1st accused and the petitioner participated. Annexure-A6 is the judgment passed in the said calendar case by which all the accused persons who faced the trial were found to be not guilty and accordingly they were acquitted. Subsequently, the 1st accused moved this Court by filing Crl.M.C. No.5861/2021 for quashing the proceedings against him and as per Annexure-A7, the said Crl.M.C. was allowed and the proceedings against him was quashed.
