This Bail Application is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita.

2. The petitioner is the 2nd accused in Crime No. 1155/2024 of Sakthikulangara Police Station. The above case is registered against the petitioner and others alleging offences punishable under secs. 318(4), 111 and 3(5) of the Bharatiya Nyaya Sanhita , 2023 (for short ' BNS ').

3. The prosecution case is that the accused persons in furtherance of their common intention to cheat the defacto complainant and thereby to get illegal profit, the petitioner, on behalf of the 1st accused, took 42 air tickets from the defacto complainant with 3 days credit. The tickets was worth Rs.13,15,477/-. It is also stated that the 1st accused handed over the cheque and the same is dishonoured. Hence, it is alleged that the accused committed the offences.

4. Heard counsel for the petitioner and the Public Prosecutor.

5. The counsel for the petitioner submitted that even if the entire allegations are accepted, the ingredients of cheating is not made out. The counsel submitted that the petitioner has no involvement in this case and the ticket is taken by the 1st accused for his business purpose. It is also subm
