The petitioner aggrieved by the interim order of maintenance ordered against him in a proceeding under Section 12 of the Protection of Women from Domestic Violence Act , 2005, by which he was directed to pay interim maintenance at the rate of ₹10,000/- has approached the learned Additional Sessions Judge I, Mavelikara in Crl. Appeal 197/2017. The learned Sessions Judge by order in Crl.M.P. No.411/2017 granted a stay, subject to the condition that the petitioner herein shall pay the entire arrears of maintenance at the rate of ₹8,000/- per month and shall pay and continue to pay at the rate of ₹8,000/- per month till the disposed of the appeal. Not satisfied with the above order, the petitioner has approached this Court assailing the interim order passed by the court.
2. It is evident that the order of interim maintenance granted by the learned Magistrate was modified by the appellate court. Pending the appeal the learned Sessions Judge reduced it to ₹8,000/-. It is pertinent to note that these proceedings arose from an order of interim maintenance and normally the higher courts will be slow in interfering in orders of interim maintenance.
