JUDGMENT

Abdul Rehim,J O.P (Waqf) No. 10/2019 was filed by the plaintiffs in W.O.S No. 1/2018 on the files of the former Waqf Tribunal, Ernakulam (VI th Additional District Court, Ernakulam) seeking the following reliefs:

“a. Issue appropriate directions to the VI th Additional District Court, Ernakulam which was functioning as the erstwhile Waqf Tribunal, Ernakulam to transmit the file of W.O.S No.1 of 2018 to the newly constituted Waqf Tribunal, Kozhikode as expeditiously as possible.

b. To issue a direction to the 9th respondent-

Returning Officer, to seize the original records of the 1st respondent Jamaath including those mentioned in Ext.P9 to ensure that fair and proper election is conducted in a time bound manner coupled with a direction to the Station House Officer, Mannuthy Police Station, Thrissur District to render adequate and effective Police assistance to the Returning Officer to seize such records.

C. To grant any other further or consequential reliefs, including any interim reliefs, as may be prayed for and deemed fit by this Honourable Court; and D. To allow the above Original Petition with costs.”

2. Evidently, the Waqf Tribunal had passed an interim order in W.O.S No.
