JUDGMENT

Petitioner is the 1st respondent in O.P.(MV) No.219 of

2002 on the files of the Motor Accidents Claims Tribunal, Attingal, instituted by the 1st respondent in the writ petition seeking compensation for the injury sustained to him in a motor accident. According to the petitioner, even though he was the registered owner of the vehicle, he sold the vehicle met with the accident much prior to the accident. Petitioner was employed abroad even before the accident, and hence no notice was served on him. An ex-parte award was passed against the petitioner while he was abroad. On coming to know about the award, petitioner filed I.A.No.3085 of 2012 for setting aside the ex-parte award and I.A.No.3084 of 2012 for condoning the delay of 1155 days in filing the petition for setting aside the ex-parte award. The MACT, after elaborate consideration of the rival contentions, has passed Ext.P8 order dismissing the application seeking condonation of delay on the ground that petitioner failed to establish before the court with supporting documents the contentions raised in the application, and consequentially the application for setting aside the ex-parte award was also dismissed.
