HIGH COURT OF KERALA
BABU MATHEW P.JOSEPH, J
RAMADAS – Appellant
Versus
STATE OF KERALA – Respondent
CRL.A/2030/2008

Advocates:
SRI.A.C.DEVY, SMT. M.G. LISHA

Unexplained delays in the production of evidence and investigation undermine the prosecution's case, leading to the acquittal of the accused.

Headnote:

Abkari - Conviction - Abkari Act - Section 58 - The court found that unexplained delays in property production and investigation compromised the integrity of evidence, leading to acquittal.

Fact of the Case:

The appellant was convicted under the Abkari Act for possessing 8 litres of arrack. The Excise Inspector arrested him after finding the contraband, but significant delays in the investigation and court proceedings raised concerns about evidence integrity.

Finding of the Court:

The court concluded that the unexplained delay in producing the contraband and failure to establish a proper chain of custody for the sample evidence were fatal to the prosecution's case.

Issues: Whether the prosecution proved the charges against the appellant despite the presence of procedural delays and lack of evidence integrity.

Ratio Decidendi: Conviction requires proof beyond reasonable doubt, and procedural lapses and delays can undermine the prosecution's case.

Final Decision: The appellant is acquitted of the offence under Section 58 of the Abkari Act.

JUDGMENT
