HIGH COURT OF KERALA
P.R.RAMACHANDRA MENON, J
P P JOY – Appellant
Versus
THE SECRETARY – Respondent
JUDGMENT
The petitioner claims to be the proprietor of a saw mill being run in the name and style as St. Joseph's Saw Mill Aimury, Koovapady P.O., which is a Small Scale Industrial Unit engaged in the manufacture of packing case using rubber wood. It is stated that, the petitioner has installed machinery with 15 H.P motor and a cutter having 5 H.P motor. The licence issued to the Unit by the 6th respondent expired on 31.3.2013 and necessary application for renewal has been filed before the said respondent. However, in view of the objection raised by the 6th respondent that the petitioner has to produce NOC from the Forest authorities and the Pollution Control Board, necessary steps were taken by approaching the said authorities as well. The grievance of the petitioner is that, in spite of filing Ext.P9 application before the concerned authority of the Forest Department, the same is still to be acted upon and hence the writ petition.
2. Heard the learned Standing Counsel for the Pollution Control Board, learned counsel for the Panchayath and also the learned Government Pleader for respondents 1 and 2.
3. It is brought to the notice of this Court by the learned Special Government Pleade
