JUDGMENT

The main prayers in this Original Petition (Civil) filed under the enabling provisions contained in Article 227 of the Constitution of India are as follows :

i. to set aside Ext.P3, P6 and P7 in EP No.31/2006 in OS No.483 of 2001 of Munsiff's Court, Cherthala.

ii. to stay all further proceedings in EP No.31/2006 in OS No.483/2001 before the Munsiff's Court, Cherthala.

iii. issue such other orders, directions or writs as may be prayed for and that this Hon'ble Court may deem fit on the facts and circumstances of the case.

2. Heard Sri.Suvin R.Menon, learned counsel for the petitioner. In the nature of the orders supposed to be passed in the original petition (Civil), notice to respondents will stand dispensed with.

3. Sri.Suvin R.Menon, learned counsel for the petitioner would submit that the petitioner is the legal representative of the deceased sole defendant in O.S.No.483 of 2001 on the file of the Principal Munsiff Court, Cherthala, in which judgment and decree was rendered on 29.03.2003. The petitioner's father died on 20.06.2005. All along the petitioner was abroad and he was unaware of the proceedings of the trial court, and that, now the petitioner has filed Ext.P1 appe
