O R D E R

The petitioner is the 7th accused in Crime No.272/2010 of Parappanangadi Police Station. In the said case, after concluding the investigation, the Police has filed a report under Section 173 (2) Cr.P.C. before the Judicial First Class Magistrate Court-I, Manjeri. The Magistrate took the final report on file and numbered it as C.C.No.398/2015. In view of the involvement of an offence purely triable by a Special Court, the case was committed by the Magistrate to the Court of Sessions, Manjeri, being the designated special court for trial of offences under the Protection of Children from Sexual Offences Act , 2012 (for short 'the POCSO Act'). The Court of Sessions received the case on its file as S.C.No.436/2016 and it is pending trial.

2. It is the case of the petitioner that the Police has visited his house in search of him to execute a Non Bailable Warrant pending against him. According to him, he has not been served with summons in S.C.No.436/2016 from the Court of Sessions, Manjeri.
