J U D G M E N T
The petitioner is a candidate at the election to the Managing Committee of the Thirurngadi Taluk Co- operative Education Society Limited No.M.515, registered under the provisions of the Kerala Co-operative Societies Act, 1969 and the Kerala Co- operative Societies Rules, 1969 (hereinafter referred to as the Act and Rules for short). As per the election notification Ext.P1, there are 8 seats to which election has been notified in which, 2 seats are reserved for women. The case of the petitioner is that she had submitted her nomination to one of the seats reserved for women. However, she complains that the Returning Officer has published Ext.P5 final list of candidates showing her name as Sl. No.3, included in the general category. According to the petitioner, she being a woman is entitled to contest from the constituency reserved for women. There is no justification for not accepting her W.P.C. No.20124 of 2014 2 nominations as one to contest from the reserved constituency. Therefore she seeks the issue of appropriate directions in this regard.
