J U D G M E N T

The short issue in this writ petition is with regard to the grant of affiliation for the petitioner's college by the 1st respondent, APJ Abdul Kalam Technological University. AICTE granted extension of approval on 27.04.2018. The University refused to grant affiliation on the ground that there are complaints pending before the State Human Rights Commission. No doubt, such complaint is not a reason at all for declining approval.

2. However, learned Standing Counsel appearing for the University points out existence of certain deficiencies as referred in Ext.R1(a). Anyhow, this Court is of the view that the petitioner's request for affiliation can be considered only for the next year, in view of the time schedule as stipulated in Parshvanath Charitable Trust and Others vs. All India Council for Technical Education ((2003) 3 SCC 385)

W.P.(C) No.19643/2018 2 wherein the Supreme Court held that cut off date for granting approval by the AICTE was 10.04.2018. Since the petitioner had obtained AICTE approval only on 27.04.2018, petitioner's application for affiliation can be considered only for the next year provided the petitioner cures all the deficiencies pointed out in Ex
