O R D E R
The prayers in this Original Petition (Civil) filed under the enabling provisions contained in Article 227 of the Constitution of India are as follows :
“(I) To call for the records leading to Exhibit-12 on the file of the IIIrd Additional Sub Court, Kozhikode, and set aside the same and thereby allow Exhibit-P9 application to meet the ends of justice.
(II) Such other reliefs that this Honourable Court may be pleased to grant during the course of arguments.”
2. Heard Sri.K.Saneesh Kumar, learned counsel appearing for the petitioners/defendants 1 to 3. In the nature of the orders proposed to be passed in this Original Petition (Civil), notice to the respondents will stand dispensed with.
3. The order under challenge is the one at Exhibit-P12.
Paragraphs 9 and 10 of Exhibit-P12 order reads as follows :
“9. All the other decisions cited by the learned counsel for the petitioners are with regard to the admissibility of the document and admissibility of certified copies. The admissibility of a document and marking of a document are entirely different.
