JUDGMENT

The common appellant in these appeals is the 3rd respondent in W.P.(C) No.28416 of 2008 and 6th respondent in W.P.(C) No.28664 of 2008.

2. Along with the appellant, the writ petitioners before the learned Single Judge, admittedly applied for appointment as Authorised Retail Distributors (for short known as ARDs). This pertains to running of ARD No.351 of Thrissur Taluk. The District Supply Officer found the present appellant, Smt.Kochurani, as eligible candidate to grant licence but the same came to be challenged by the other two applicants who are the writ petitioners before the learned Single Judge. The District Collector allowed the contention of the writ petitioners by order under Ext.P6 in W.P.(C) No.28664 of 2008 holding the present appellant as ineligible to be appointed as ARD. However, without considering the other two applications, while rejecting the candidature of Smt.Kochurani the District Collector ordered for re-notification for appointment as ARD. This again came to be challenged before the Commissioner of Civil Supplies who set aside the order of the District Collector as per Ext.P8, wherein the consideration of the applications of w
