JUDGMENT

The prayer in this writ petition is to quash Ext.P7 and direct the 2nd respondent to re-issue/renew Ext.P3 and permit the petitioner to remove ordinary earth for the purpose of construction of the residential house by considering Ext.P6 application. This Court had directed the additional 3rd respondent- the Geologist to inspect the property and submit whether the property comes under the category of hilly terrain with steep slopes.

2. The Government Pleader on instructions submitted that the additional 3rd respondent on inspection has found that the area is not hilly terrain with steep slopes. It is also submitted that the additional 3rd respondent has found that unless retaining walls are put up on the North, South and West, the removal of ordinary earth can cause damage.

In view of the fact that the area in question does not form part of hilly terrain with steep slopes, Ext.P8 judgment would not apply. As a result, this writ petition is allowed. Ext.P7 is set aside. There will be a direction to the respondents 1 and 2 to reconsider the application submitted by the petitioner for removal of ordinary earth and permit the same on condition that the petitioner puts up the necessary retaining wall as opined by the additional 3rd respondent in order to safely carry out the excavation. Necessary orders shall be issued within two weeks from the date of receipt of a copy of this judgment.
