ZIYAD RAHMAN A.A., J
ANSON T. A. – Appellant
Versus
MAR AUGUSTINE HIGHER SECONDARY SCHOOL – Respondent
WP(C) NO. 26430 OF 2022

Advocates:
For the Appellants/Petitioners: C.K.PAVITHRAN, NEENU PAVITHRAN
For the Respondents: JESWIN P.VARGHESE, SAROJINI K.G., V. VARGHESE

The appointment of disabled candidates must follow the reservation policies, and candidates must be sponsored by the Employment Exchange to claim such rights.

Headnote:(A) Right of Persons With Disabilities Act, 2016 - The petitioner's claim for reservation in appointment as Lab Assistant was denied, arguing no compliance with the provisions of the Act. The respondents pointed out that the petitioner was not a candidate sponsored by the Employment Exchange and a vacancy arose fulfilled by another appointment. Court observed the obligation on the establishment to provide reservation, which was met. (Paras 2, 8, 10)

(B) Appointments - The requirement for candidates with disability to be sponsored by the Employment Exchange is necessary for claiming a right to appointment under the reserved quota. (Para 10)

Facts of the case:
The petitioner alleged denial of reservation in an appointment as Lab Assistant based on the RPWD Act, after an application was submitted against the appointment of a general merit candidate.

Findings of Court:
The respondents had fulfilled their obligation by appointing a physically disabled candidate against the first available vacancy before appointing the general merit candidate.

Issues: Whether the appointment process followed the mandatory requirements under the RPWD Act and the petitioner's right to challenge the appointments made.

Ratio Decidendi: The court found the petitioner lacked the right to challenge due to the absence of sponsorship by the Employment Exchange and the established compliance by the institution with obligations under the Act.

Result: The writ petition is dismissed.

The case of the petitioner is as follows:

The 1st respondent invited applications from qualified hands for filling up of the post of Lab Assistant. In pursuance to the same, the petitioner submitted an application. The notification was issued for filling up of the vacancies from general merit. As the Manager of the 1st respondent had taken a decision to appoint the 4th respondent, without providing any reservation as contemplated under the RPWD Act, 2016, the petitioner submitted a complaint before the 1st respondent as evidenced by Ext.P4. A WP(C) No. 26430/2022 4 similar complaint was submitted before the 2nd respondent as well, which is produced as Ext.P6. According to the petitioner, the 1st respondent should not have filled up the vacancy that arose in the post of Lab Assistant without fulfilling the obligation to make necessary appointments by following the reservation contemplated under the RPWD Act, 2016. The Government Orders dated 18.11.2018 and 08.11.2021, which are produced as Exts.P8 and P9, were also relied on by the petitioner. As the complaints submitted by the petitioner before the 1st and 2nd respondents did not evoke any response, the petitioner approached this Court seeking the following reliefs:

In the said selection process, 18 persons, including the petitioner were participated, and after conducting the interview at the office of the 1st respondent, a rank list was prepared wherein, the 4th respondent was the 1st rank holder. On the basis of the same, the 1st respondent appointed the 4th respondent as Lab Assistant with effect from 31.05.2020 onwards. The right of the petitioner to claim reservation for the post of Lab Assistant in which the 4th respondent was appointed was also objected to by the 1st respondent in view of the fact that the petitioner does not have a case that he is a candidate sponsored by the Employment Exchange.
